By accessing and using Neawist ("the Service"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use this service.

These Terms are governed by Dutch law and EU regulations, including the Digital Services Act (DSA) and GDPR.

2. Description of Service

Neawist is a neighborhood review platform that allows users to search for neighborhoods, read reviews from residents, and share their own experiences about living in specific areas. Our service helps people make informed decisions about where to live.

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account

3.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these terms

4. Community Guidelines & User Content

4.1 Our Community Standards

Neawist is built on trust and authentic experiences. To maintain a respectful and helpful community, all users must follow these guidelines when posting reviews and interacting with others.

4.2 Content License Grant

By posting reviews or other content on Neawist, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to:

• Display, reproduce, and distribute your content on our platform
• Create anonymized aggregations and analytics based on your content
• Modify formatting for display purposes (e.g., mobile vs desktop)

You retain full ownership of your content. If you delete your account, we will anonymize your reviews (remove your name and profile) while keeping the review content to preserve community value. You can request full deletion by contacting [email protected], subject to legal retention requirements.

4.3 Content Guidelines

✓ You must:

• Share genuine personal experiences based on first-hand knowledge
• Provide honest, accurate, and helpful information
• Respect other users and maintain a civil tone
• Focus on the neighborhood and public spaces, not specific individuals
• Express opinions respectfully and constructively

✗ You must not:

• Post false or fake content: No fake reviews, reviews for places you haven't experienced, or manipulation of ratings
• Be abusive or offensive: No hate speech, harassment, threats, discrimination, or attacks on individuals
• Violate privacy: No sharing personal information about specific people (names, photos, contact details)
• Post illegal content: Nothing that violates Dutch or EU law
• Spam or advertise: No promotional content, advertisements, or commercial solicitations
• Share dangerous content: No instructions for illegal activities or self-harm
• Violate copyrights: Only post content you have the right to share

4.4 One Review Per Place Rule

To maintain integrity and prevent manipulation:

• You may post one review per residential address where you have lived or visited
• You may post one review per neighborhood you have experience with
• You can edit your review at any time to update your experience
• Creating multiple accounts to post multiple reviews is strictly prohibited

4.5 Content Moderation & DSA Compliance

As a hosting service provider under the EU Digital Services Act (DSA), we:

• Do not pre-moderate: Content is published immediately, but may be reviewed afterward
• Respond to reports: We investigate reported content and take action without undue delay
• Reserve the right to remove: Content that violates these Terms, our Community Guidelines, or applicable law
• May suspend or ban: Users who repeatedly violate our policies
• Provide appeals: You can appeal content removals by contacting [email protected]

4.6 Notice-and-Action Mechanism

To report illegal or violating content:

• Click the "Report" button on any review or content
• For urgent legal matters, email [email protected]
• We will review and respond within 48 hours for standard reports, faster for urgent legal issues

4.7 Consequences of Violations

Depending on the severity and frequency of violations, we may take the following actions:

• Content removal: The violating review or comment is deleted
• Warning: You receive a notification explaining the violation
• Temporary suspension: Your account is suspended for a period (7-30 days)
• Permanent ban: Your account is permanently terminated for serious or repeated violations
• Legal action: In cases of illegal content, we may report to authorities as required by law

5. Prohibited Uses

You may not use our service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To scrape, extract, or systematically collect data from Neawist using automated tools, bots, or scripts without explicit written permission

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Neawist and its licensors. The service is protected by copyright, trademark, and other laws.

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

8. Disclaimers and Liability Limitations

8.1 "As Is" Service

The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Neawist excludes all representations, warranties, conditions and terms relating to our service and the use of this service.

8.2 User-Generated Content Disclaimer (DSA Safe Harbor)

Important: Neawist is a hosting intermediary under the EU Digital Services Act (DSA). We:

• Do not endorse or verify user reviews. Reviews are personal opinions of individual users and do not represent the views of Neawist.
• Are not responsible for accuracy: We do not guarantee the accuracy, completeness, legality, or reliability of any user-generated content
• Act as a neutral platform: We provide the infrastructure for users to share reviews, but are not liable for the content itself
• Respond to notices: We take action upon receiving valid notices of illegal content under DSA procedures

You use reviews at your own risk. Always verify information independently before making important decisions (e.g., signing a lease, purchasing property).

8.3 No Professional Advice

Neawist does not provide real estate, legal, financial, or professional advice. Reviews are personal experiences and should not be relied upon as professional guidance. Always consult qualified professionals for important decisions.

9. Limitation of Liability

In no event shall Neawist, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

10. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

12. Governing Law

These Terms shall be interpreted and governed by the laws of the Netherlands, without regard to its conflict of law provisions.
